Terms of Service

Welcome to GELATO (pshhpunk.com). GELATO is an independent site that covers underground music, artists, visuals and culture. These Terms of Service explain the rules for using the site, sending us your music, and taking part in our community. Please read them. By visiting or using GELATO, you agree to these terms. If you don't agree, please don't use the site.
1. Who can use GELATO
You must be at least 13 years old to use GELATO. If you are under 18, you need permission from a parent or guardian, and they agree to these terms on your behalf. If you use GELATO for a business, band, label or other group, you confirm you are allowed to accept these terms for them.
2. Using the site
You may browse, listen to, watch and share GELATO for your own personal, non-commercial use. While using the site, please don't:
- copy, resell or republish large parts of the site without our written permission;
- scrape or harvest content or data with bots or automated tools;
- try to break, overload, hack or get around the security of the site;
- upload or link to viruses, malware or anything meant to cause harm;
- pretend to be someone else, including an artist or a member of our team;
- use the site for anything illegal.
We may limit or end anyone's access to GELATO if they break these rules.
3. Our content and other people's content
The GELATO name, logo, site design, and the writing, rankings and descriptions we create belong to GELATO. Please don't use them without asking first.
The music, artwork, photos and videos we feature belong to the artists, labels, photographers and creators who made them. We feature work to celebrate and promote it, and we credit creators wherever we can. Songs and videos usually play through embedded players from services like SoundCloud, Spotify, YouTube and Instagram. Those players are run by those companies, and their own terms and privacy policies apply when you use them.
4. Sending us your music or work
When you submit music, artwork, links or other material to GELATO, for example through our Promote Your Music page:
- you confirm you own the work, or have permission from everyone who does, to send it to us and let us feature it;
- you keep ownership of your work;
- you give GELATO a free, non-exclusive, worldwide permission to display, embed, describe and share the work, and your name, image and links, on the site and our social channels, to feature and promote it;
- you understand that sending something in does not guarantee it will be featured, and that we may edit how it is presented or remove it at any time.
If you want something you sent us taken down, contact us and we will remove it from the site within a reasonable time.
5. Community posts and chat
Our Community Posts area shows a live Discord chat. Discord's own terms and community guidelines apply when you post there. Keep it respectful: no harassment, hate speech, threats, doxxing, spam, scams, or sharing anything illegal or anything you don't have the rights to. We may remove posts or block users who break these rules. Posts reflect the views of the people who write them, not GELATO.
6. Copyright concerns
We respect creators' rights. If you believe something on GELATO uses your work without permission, email us at gelatomgmt@gmail.com with: your name and contact details, a description of the work, the page link where it appears, and a statement that you own the rights or are authorised to act for the owner. We will review every request and remove material where appropriate.
7. Advertising and paid promotion
Some placements on GELATO, such as banners, sponsored posts and featured artist spots, may be paid. We aim to make sponsored content clear. Details of any paid promotion, including price, timing and what is included, are agreed with you before work starts. Unless we agree otherwise in writing, payments for promotion are non-refundable once the promotion has started or gone live.
8. Links to other sites
GELATO links to and embeds content from other websites and apps. We don't control them and aren't responsible for their content, availability or practices. Visiting them is at your own risk and under their terms.
9. Privacy
Your use of GELATO is also covered by how we handle information. Embedded players, chat and analytics tools may collect information under their own privacy policies.
10. No guarantees
GELATO is provided as it is and as available. We work to keep the site accurate and running, but we don't promise that it will always be available, error-free, secure or up to date, or that any content is complete or correct. Opinions, ratings and rankings on GELATO are our own views.
11. Limits on our responsibility
To the fullest extent the law allows, GELATO and the people who run it are not responsible for any indirect, incidental or consequential losses, or for loss of data, profits or reputation, that come from using or not being able to use the site, from content posted by others, or from third-party services. If we are found responsible for something, our total responsibility is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid us nothing.
12. Your responsibility to us
If someone makes a claim against GELATO because of material you submitted, something you posted, or your breaking these terms or the law, you agree to cover the reasonable costs and losses that result, including legal fees.
13. Changes
We may change the site, or these terms, at any time. When we change the terms we will update the date at the top of this page. If you keep using GELATO after a change, that means you accept the updated terms.
14. General
These terms are the full agreement between you and GELATO about using the site. If any part is found unenforceable, the rest still applies. If we don't enforce a rule straight away, we can still enforce it later. You may not transfer your rights under these terms, but we may transfer ours, for example if GELATO is sold. These terms are governed by the laws of the State of California, United States.
